Contractor for Winnipeg police HQ launches cross-claim against co-defendant in city lawsuit

 

Caspian Projects says any damages a court orders over alleged construction deficiencies at the Winnipeg Police headquarters should be charged to an engineering consultant, not Caspian.

The HQ contractor added to its $7.9-million countersuit against the city over the project by launching a cross-claim against Adjeleian Allen Rubeli Limited on Aug. 1. The latest court action aims to see AAR held accountable for any potential damages awarded to the city in the case.

“Caspian says that if the plaintiff (the city) suffered loss and damage as alleged, which is not admitted but denied, same was caused or contributed to by the negligence of AAR,” the court document says.

The city launched a lawsuit against AAR and Caspian in May, which seeks unspecified damages over alleged deficiencies at the 245 Smith St. headquarters. The city alleged both companies were “negligent” in their work on the building, while both companies have since denied any wrongdoing.

None of the allegations have been proven in court.

Caspian Projects didn’t respond to a request for comment on Thursday.

The city has said its total damage estimate for alleged headquarters deficiencies will exceed $10 million, which it claims includes issues with a structural slab, waterproofing, drainage and temperature controls.

The cross-claim follows similar court action that AAR launched in July, which called for Caspian to pay out any damage relief awarded to the city.
